“快速移民”（Express Entry）已成为中国留加学生毕业申请移民主要途径，而毕业时申请“专上毕业工签”是移民准备的第一步，但申请人必须注意申请工签被拒三大陷阱，包括修读外国学校在加拿大开办的课程、修读网上课程，以及申请材料不齐而导致被拒。
移民律师辛湉王（Steven Meurren）列出容易造成工签被拒的三大陷阱。
他指出，很多中国留学生视专上课程毕业，一定能够取得“专上毕业工签”为理所当然，事实上却不然。他表示，工签规定复杂，规定细节当中又有模糊地带，留学生应要在选择学校前即掌握个中
窍门，否则可能读了几年课程，到最后却发现所读的课程根本不符
合申请资格。
他列出的三大被拒陷阱，第一项便是留学生就读的学校并非加拿大注册的专上学校，而是外国学校在本地开办的课程。根据规定，这类课程的毕业生无资格申请“专上毕业工签”。不过，他补充说，如果所就读的学校最终能授与加拿大认可的教育文凭，即使该课程包括海外交换学生课程，学生毕业后仍有资格申请工签。
被拒陷阱之二是所读的课程中，若有部分是网上课程，便不合资格申请工签。辛湉王说，去年移民部即拒绝了一间私立专上学校毕业班全班同学的工签申请，被拒理由就是该课程中有一部分是网上课程，结果引起被拒学生入禀联邦法院，要求法庭介入，就有关事件作出裁决。辛湉王表示，学生方面要求法官审裁，移民部是否应该详细列出不合资格的课程，以及网上课程占整体课程的比例多少，才算不合资格。他预期联邦法院或是移民部，应该会在今年内对网上课程的比例作出明确指引，而在此之前，他不建议欲申请工签的留学生，修读有网上学习的课程，以免被拒。
被拒陷阱之三是申请时资料不齐全。辛湉王说，任何申请若资料不齐全，均会被拒，一般其他的移民申请，若因为资料不齐全而遭到退件，而申请人的签证若已接近到期，则申请人有90天时间可以申请延续居留资格；不过，最近却有一些“专上毕业工签”资料不齐的申请人，却未获得90天申请延续居留资格的安排，使得学生签证最终过期，无法再申请工签。
他说，有关申请资料不齐全而导致丧失居留资格无法延续的问题，目前也有申请人告上联邦法院，相信不久将来联邦法院或是移民部亦将作出明确指引。
四项规定必须遵守
留学生在专上课程毕业后，只要所读课程的学习时间达到8个月或以上，不管就读的是公立或是私立专上院校，均可以在毕业后申请“专上毕业工签”，毋须事先找到雇主，也能申请工作签证。
移民部对专上毕业工签申请资格所定的规定包括：
- 申请时必须持有效学生签证
- 连续在加拿大专上院校全日制就读，但课程的最后一个学期，则可允许非全日制修读（part-time studies）
- 至少完成8个月的学习。
- 毕业后90天内必须提出申请。
至于“专上毕业工签”的有效期，则与所读课程时间相当，但达到两年或以上的课程，则可获得3年有效期的工签。举例来说，完成2年课程，或是4年课程的留学生，最后都能拿到3年有效的工签。
此外，需要注意的是，工签有效期是根据课程长短而定，与学生实际学习时间的长短无关，例如，若有学生花了6个月时间，完成一项8个月的课程，等于提前完成，那么他的工签有效期仍是8个月。

何为“专上学院”
通常和国内指的大专类似，在加拿大也叫社区大学，college，课程一般为2-3年的专业课程，毕业后有专业文凭，但大都没有学位。不过有的学院也有获得本科或研究生学位的课程。
